如果说四卷本《宪政中国的当代叙事》收集的是我针对当代中国宪 法事件的短篇时评，那么接下来的四卷本将是我在过去二三十年的任教期间对宪政制度的理论与实践的长篇论文，分别探讨中外宪政的理 论、机制、人民的基本权利以及国家权力结构。 权利保障只有通过有效的宪法制度才能实现。
第四卷探讨司法独立、 司法审查、法治统一与地方自治等制度。虽然宪法实施最终要靠人民 自己，司法审查等宪法制度的关键作用是显而易见的。任何一个法院 只要能出一个正经八板的宪法判决，那将是对宪政何其巨大的推动！可时至如今，不仅2001年最高法院的"宪法第一案"早已废止、再无来者，中国当下仍然只是在"备案审查"这类技术细节上蹒跚而行，而且连"司法独立"都成了言论禁区。司法审查和司法改革是大陆法律人的普遍关注，但如果连政治独立都做不到，这样的法院如何能承受司法审查的重任？在地方民主自治都没有做到的情况下，司法改革自上而 下的单兵突进很难持久，最终免不了"人存政举、人亡政息"的宿命。
