密尔顿说："真理是在战场诞生的。"思想是在自由交流 和交锋的大环境下形成的，也只有经过不断交流和交锋才能得 到有效传播。传播宪政思想和理念无疑是我的一个工作重点。 过去二十年，我利用一切有限的机会和不同范围的公众交流， 尽可能普及宪政常识。这些常识涉及宪政的方方面面，从宪政的必要性、宪政的伦理和认知基础、宪政的实现路径等相对 "务虚"的话题，到具体的宪法权利与自由、制度设计、分权 模式、合宪性与合法性审查模式等相对"务实"的课题。在此分为五卷，分别涵盖理论、路径（改良）、伦理基础（尊严）、宪法自由和权力控制机制。
第五卷探讨宪政的制度层次，简言之就是民主+法治。法治的前提是分权，横向和纵向都得分。如果中央或其中的某个部门--尤其是行政--权力过大，那就只能有党治或人治，怎么可能有法治呢？事实上，政府权力过大或过于集中，也不会允许社会自发生成契约。社会契约的另一个组成部分是选举民主，而选举民主的前提也是对公民尊严的对等承认。现在不少号称皈依"保守主义"的"自由派"连"一人一票"都不承认，可见平等尊严这个前提是不存在的，中国构建社会契约之路依然任重道远。
