Unter Mischlohn versteht die Untersuchung einen Gesamtlohn, der sich aus einem Festlohnanteil und einem Provisionsanteil zusammensetzt. Über den Provisionsanteil ist der Gesamtlohn teilweise erfolgsabhängig. Es stellt sich die Frage, ob diese Erfolgsabhängigkeit unter dem Gesichtspunkt einer vom Leitbild des Arbeitsvertrages abweichenden Entgeltrisikoverteilung auf einen bestimmten Prozentsatz des Gesamtlohns begrenzt werden muss. Als Kontrollinstrument dient § 307 BGB.
