In einer Zeit, in der eine transatlantische Debatte über die Frage geführt wird, ob Common Law-Länder wegen wirksameren Schutzes der Privatautonomie vor staatlichen Interventionen besser regiert seien als Zivilrechtsländer römischer Tradition, verdient der deutsch-japanische Gedankenaustausch über ein Vertragsrecht, das Privatautonomie und Schutzinteressen in angemessenen Einklang bringt, umso mehr Aufmerksamkeit. Im Lichte der gesetzgeberischen Interventionen der vergangenen Jahrzehnte sowohl in Deutschland als auch in Japan geht es dabei besonders um eine kritische Erörterung von Verbraucherschutz und Diskriminierungsverboten.
