Die Benachteiligung der Frau gegenüber dem Mann in ist in Europa historisch gewachsen und erstreckt sich auf alle Lebensbereiche. Gerade im Wirtschaftsleben, wird sie besonders deutlich. Im Recht der Europäischen Union (EU) und bei seiner Durchführung durch die Mitgliedsstaaten darf sich diese Ungleichheit nicht fortsetzen. Vielmehr muss ein Beitrag zum Abbau von Diskriminierungen und zur Förderung der Gleichstellung der Geschlechter geleistet werden. Um dies zu erreichen sieht die EU unterschiedliche rechtliche Instrumente vor, deren Besonderheiten und Unterschiede in dieser Arbeit aufgezeigt werden. Ziel ist es, festzustellen, inwiefern sie zur Verwirklichung der Gleichstellungsziele beitragen. Neben den Rechtsgrundlagen, wird auch die Rechtsdurchsetzung durch den Europäischen Gerichtshof (EuGH) dargestellt und an Beispielen näher erläutert.
