Al no existir normas que en forma especifica señalen como determinar los criterios de aplicación de la reparación civil y si necesariamente en todos los delitos debe de aplicarse vemos con gran preocupación que del análisis de diversas sentencias judiciales referentes a delitos de peligro, sobre todo en los de peligro abstracto, se ha verificado que sin ningún criterio jurídico los operadores judiciales, al tomar una decisión, no se han preocupado por sustentar con argumentos de hecho y de derecho ello, el determinar, cuando no corresponde, una reparación de por más arbitraria. Al determinar una reparación civil sin el más mínimo criterio, conlleva a que el sentenciado se vea afectado a fin de pagar un daño inexistente, puesto que no se ha lesionado, ni vulnerado bien jurídico materia de protección.
