Zuvor wird auf die Bedeutung des Konsultationsrechts beziehungsweise seinen stärkeren, großen Bruder, das Recht auf PIC für die indigenen Völker, deren Lebensführung und Entfaltung ihrer Menschenrechte eingegangen. Ebenso geht es um das Verhältnis zwischen Konsultationsrecht und Recht auf PIC, sowie die Konfliktsituation, die notwendigerweise aus dem Spannungsverhältnis zwischen staatlicher Souveränität und der Verleihung spezifischer Rechte an einzelne Bevölkerungsgruppen resultiert. Im Zuge dieser Darstellungen wird versucht werden, die am meisten divergierenden Standpunkte der Staaten und der indigenen Völker zu beleuchten und ein mögliches Lösungsmodell vorzustellen.
