In der Arbeit wird der Frage nachgegangen, welche Instanz bei Menschenrechtsverletzungen in Europa das letzte Wort hat. Insbesondere der Europäische Gerichtshof in Luxemburg und der Europäische Gerichtshof für Menschenrechte in Straßburg konkurrieren beim Schutz der Menschenrechte auf europäischer Ebene. Anhand der aktuellen Rechtsprechung der beiden europäischen Gerichtshöfe wird aufgezeigt, dass dem EGMR in Straßburg de lege lata die Letztentscheidungskompetenz in Menschenrechtsfragen zusteht. Zudem stellt die Abhandlung dar, welche rechtlichen Probleme für einen kohärenten Grundrechtsschutz nach wie vor bestehen und wie diese de lege ferenda aufgelöst werden können.
