Consent in Personal Data Protection

At the heart of Beninese positive law, consent is the preferred legal pillar for legitimizing the processing of personal data. Consecrated by Book V of the digital code in Benin and other international and regional legal instruments, consent represents the cornerstone of informational self-determination which is recognized by the manifestation of the will of the person concerned. Faced with the lack of intellectual mastery of these tools by users and mechanical consent to the processing of personal data, it is necessary to ask whether consent is illustrated as a formal reality or a practical illusion with regard to the digital issues?
